'DRONES' AND UNMANNED AIRCRAFT SYSTEMS

There has been an upsurge in the use of Unmanned Aircraft Systems (UAS) or ‘Drones’ in the Uk over recent years, whether for commercial operations or purely by hobbyists.

There have been a number of instances in Dumfries and Galloway recently where people have contacted the Police, either complaining about drones, or seeking information about how to use them safely without getting complained about.

The legislation regarding the use of Drones is far too lengthy and complex to reproduce here, but in terms of non-commercial use of Drones, we thought it may be helpful to draw attention to some of the main points which potential users need to be aware of;

• Those operating Drones are Pilots, and are subject to various regulations, notable those contained within the Air Navigation Order 2016, but also other Statutory and Common Laws such as Drink or Drug flying, Harassment, or Culpable and Reckless Conduct etc.

• Drones should not be used within 500 feet (150m) of a congested area (i.e streets, crowds and built up areas) – Don’t Overfly. They also shouldn’t be used within 150ft (50m) of a person, vessel, vehicle or structure.

• Stay below 400feet (120m) and away from aircraft, airports and airfields

• If you use a Drone with a Camera be aware you should operate it in a responsible way, to respect the privacy of others. You may be subject to the provisions of the Data Protection Act 1988.
